Terms, Privacy & Safety

1. Platform Purpose & Responsibility

FMT is a discovery and communication platform connecting students, parents and guardians with independent teachers, tutors, coaches and educational institutions. FMT does not itself provide educational services, employ listed providers, or guarantee their identity, credentials, conduct, availability or performance.

2. Independent Verification & User Safety

Users must independently verify the identity, qualifications, experience, references, location and suitability of other users before engaging their services. Parents and guardians should arrange appropriate supervision for minors. Sports, yoga and other physical activities may involve risks. FMT is not responsible for independent user conduct except where liability cannot legally be excluded.

3. User Conduct & Account Suspension

Abuse, threats, discrimination, harassment, exploitation, fraud, impersonation and other unlawful or inappropriate conduct are prohibited. FMT may promptly restrict an account to protect users and may permanently terminate it following appropriate review. Serious misconduct may be reported to authorities; legal action may be taken. Refunds following substantiated misconduct may be denied only to the extent permitted by law.

4. Official Payments

Payments for FMT subscriptions must be made only through the authorised payment system on fmt.innacci.com. No agent, individual, third-party application or external payment link is authorised to collect FMT subscription fees. Unauthorised payments are not recognised as FMT subscription payments, subject to applicable law. Private tuition payments between users are separate from FMT subscriptions.

5. Accounts & Listings

Users must provide truthful, current information and must not create misleading or impersonated profiles. FMT may request verification and approve, reject, hide or suspend listings. Listing does not amount to certification, endorsement or police verification.

6. Subscriptions, Cancellation & Refunds

Basic registration is free; optional paid features and their prices, terms and validity are displayed before purchase. Activation requires verified gateway payment. FMT does not guarantee enquiries, admissions or earnings. Activated subscription fees are generally non-refundable for non-use or lack of leads, except where applicable law requires a refund or remedy. Recurring charges require explicit subscriber authorisation.

7. Privacy & Personal Information

FMT processes account, enquiry, communication and payment-related information for legitimate platform purposes, subject to its Privacy Policy and applicable law. Information is shared according to platform features, permissions and consent. Users must not misuse or disclose another person’s private information.

8. Complaints & Dispute Resolution

Report concerns to fmt@innacci.com. FMT may review evidence, investigate and take platform action, but does not guarantee resolution of private disputes. Users retain all statutory rights to report to police, consumer bodies and courts.

9. Limitation of Liability

FMT does not supervise independent lessons, home visits, transportation, fees or off-platform interactions. To the maximum extent permitted by law, FMT is not liable for independent user misconduct or arrangements. Nothing excludes liability or statutory rights that cannot lawfully be excluded.

10. Governing Law & Jurisdiction

Indian law governs these Terms. Subject to mandatory statutory jurisdiction and provided they otherwise have jurisdiction, competent courts in Gautam Buddha Nagar, Uttar Pradesh, India shall have jurisdiction over contractual civil disputes. Criminal investigations and mandatory consumer remedies are unaffected.

11. Changes to Terms

FMT may update these Terms for legal, security or operational reasons, with notice where required. Continued use following effective changes signifies acceptance only where legally permissible.

13. Independent Relationship Between Users

Teachers, coaches, institutions, learners and guardians act independently. Registration or subscription creates no employment, partnership, franchise, agency or joint venture with FMT. FMT does not control the way independent educators conduct lessons. Users arrange services at their own discretion.

14. Criminal Activities & Unlawful Conduct

FMT prohibits sexual harassment or exploitation, physical abuse, violence, stalking, intimidation, extortion, fraud, identity theft and other crimes. Credible serious concerns may prompt immediate restriction pending review. Substantiated violations may lead to termination, lawful record preservation, reports to authorities and legal proceedings. Criminal responsibility is determined by law; these Terms do not exclude FMT’s own legal duties.

15. Protection of Minors & Child Safety

Users must comply with applicable child-protection laws, including the Protection of Children from Sexual Offences Act, 2012 (POCSO), where applicable. Educators must maintain professional boundaries. Guardians should independently verify credentials and safeguarding arrangements. FMT may urgently restrict accounts presenting credible child-safety concerns and will comply with applicable mandatory reporting obligations.

16. Identity Verification & Background Checks

FMT may request identity documents, qualifications and professional records. A listed profile does not establish police clearance, background screening, licensing or government certification. Unless expressly stated, FMT does not perform comprehensive criminal checks of every user. Users remain responsible for independent due diligence.

17. Independent Tuition Fees & Transactions

FMT is not party to tuition fees, deposits, coaching contracts, salaries or admissions arrangements between users. It does not collect, insure, guarantee or refund independently paid tuition fees. Private payment disputes should primarily be addressed between contracting parties, without excluding FMT’s liability for its own acts or omissions.

18. Subscription Payments, Refund Disputes & Chargebacks

FMT subscriptions activate only upon authorised gateway confirmation. Refunds follow the published policy and applicable law. Users should promptly report duplicate, incorrect or unauthorised charges with transaction details. FMT may review gateway records, invoices, activation and usage logs. Fraudulent chargebacks or fabricated claims may lead to lawful action; legitimate disputes or chargebacks alone are not misconduct.

19. Misrepresentation, False Complaints & Reviews

Knowingly fabricated allegations, forged evidence, impersonated complaints and maliciously misleading reviews are prohibited. FMT may investigate and take proportionate action against substantiated deliberate abuse. An unproven complaint is not automatically false; users may raise genuine safety concerns and pursue legal remedies without retaliation.

20. Communication Records & Evidence Preservation

FMT may retain registration, consent, payment, profile, enquiry, communication and moderation records for lawful operational, security and dispute purposes, consistent with its Privacy Policy. Relevant data may be preserved under a lawful legal hold and disclosed when legally required or permitted. Deleting an account or message may not erase records subject to valid retention duties.

21. Off-Platform Meetings & Communication

Users independently arrange online or in-person lessons, home tuition, transport and communications. FMT does not supervise those arrangements. Users should assess safety and appropriate supervision. FMT may review reported platform-linked misconduct and take lawful platform action.

22. Suspension, Termination & Refund Consequences

FMT may immediately restrict access for credible safety, fraud or abuse risks. Permanent termination may follow proportionate review of available evidence. Unused subscription fees may be withheld after lawful termination for substantiated serious violations only where legally permissible. Affected users may request review through support; termination does not prevent reporting or legal action.

23. Indemnification

To the extent permitted by law, users indemnify FMT and Innacci against reasonable third-party claims and costs directly attributable to their unlawful conduct, fraud, infringement of rights or material breach of these Terms. This does not require users to cover losses caused by FMT’s negligence, unlawful acts or legal breaches.

24. Service Availability & Technical Limitations

FMT aims to provide reliable access but cannot guarantee uninterrupted operation. Maintenance, connectivity failures, hosting incidents or security events may cause interruptions. FMT will take reasonable steps to resolve issues. Users retain statutory remedies where paid services are materially unavailable or misrepresented.

25. Legal Notices, Complaints & Cooperation

Send platform complaints to fmt@innacci.com. FMT may request supporting evidence and cooperate with lawful requests by courts and authorities. Users must not fabricate evidence. Nothing prevents reports to police, courts, consumer commissions or other competent bodies.

26. Governing Law, Jurisdiction & Severability

These Terms are governed by Indian law. Subject to mandatory statutory provisions, competent courts at Gautam Buddha Nagar, Uttar Pradesh, India shall hear eligible contractual civil disputes where otherwise legally competent. Criminal investigations and statutory consumer rights remain unaffected. If one clause is unenforceable, the remaining lawful clauses continue in effect.
